Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and Tiny Waffles, Inc. ("Tiny Waffles," "we," "us," or "our") governing your use of tinywaffles.com (the "Site") and any application, utility, browser extension, or service we publish (together with the Site, the "Services"). Please read them carefully.
1. Acceptance and eligibility
By accessing or using the Services you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
You must be at least 13 years old (or the minimum age required in your country to use online services without parental consent) to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes it.
2. The Services
Tiny Waffles makes a variety of small software products. Each app may have its own documentation and, occasionally, additional terms specific to that app ("App Terms"). If App Terms conflict with these Terms, the App Terms control for that app.
We may add, change, suspend, or discontinue any part of the Services at any time. Where reasonably practical we will give notice of material changes to a Service you actively use.
3. Accounts and third-party sign-in
Some Services let you sign in or connect using a third-party account, such as a Google account. When you do:
- you authorize the Service to access the third-party account data described in the permission prompt and our Privacy Policy;
- your use of the third-party account remains subject to that provider's own terms and policies;
- you can revoke the connection at any time through the provider (for Google, the Google Account permissions page) or within the app;
- you are responsible for keeping your credentials and devices secure and for all activity under your account.
Tell us promptly at support@tinywaffles.com if you believe your account has been compromised.
4. Acceptable use
You agree not to, and not to let others:
- use the Services in violation of any applicable law, regulation, or third-party right, including privacy, anti-spam (such as CAN-SPAM), and intellectual-property law;
- use the Services to send unsolicited messages, harass anyone, or distribute malware;
- access accounts or data you are not authorized to access, or use the Services to do so;
- interfere with, overload, or circumvent security of the Services or any third-party service the Services connect to;
- reverse engineer, decompile, or extract source code from the Services except to the extent applicable law or an open-source license expressly permits;
- resell, sublicense, or commercially exploit the Services without our written permission;
- use automated means to scrape or bulk-collect data from the Services beyond what the Service's documented interfaces allow.
5. Your content
You keep ownership of any content, data, or material you provide to or process through the Services ("Your Content"). You grant Tiny Waffles a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display Your Content solely to the extent needed to provide the Services to you and as described in the Privacy Policy. This license ends when Your Content is deleted from the Services, subject to reasonable backup retention periods.
You are responsible for Your Content and represent that you have all rights needed to provide it to the Services and to grant the license above. We do not claim ownership of Your Content and we do not use it to train machine learning models.
6. Intellectual property
The Services, including software, design, text, graphics, logos, and the Tiny Waffles name and waffle marks, are owned by Tiny Waffles or its licensors and are protected by copyright, trademark, and other laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Services as intended. Any software we release under an open-source license is governed by that license for the covered code.
If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation.
7. Third-party services and links
The Services may rely on or link to third-party services (such as Google, hosting providers, or AI model providers). We do not control and are not responsible for third-party services, their availability, or their content, and your use of them is subject to their own terms.
8. Beta and experimental apps
Some Services are labeled beta, preview, experimental, or similar. They may be incomplete, contain bugs, change without notice, or be withdrawn. Use them with that in mind and keep backups of anything important. The disclaimers and liability limits below apply with particular force to beta Services.
9. Fees
The Services are free unless a price is clearly stated for a specific app or feature. Where fees apply, the pricing, billing, and refund terms shown at the point of purchase form part of these Terms. We may change prices for future periods with reasonable notice.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue a Service. Sections that by their nature should survive termination (including Sections 5, 6, 11, 12, 13, 14, and 16) survive.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RESULTS (INCLUDING ACTIONS TAKEN ON YOUR THIRD-PARTY ACCOUNTS AT YOUR DIRECTION) WILL BE ACCURATE OR COMPLETE. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TINY WAFFLES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY US DOLLARS (US$50). These limits do not apply to liability that cannot be limited under applicable law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Tiny Waffles and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of Your Content, your use of the Services, or your violation of these Terms or of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to their personal jurisdiction and venue. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.
Before filing a claim, you agree to first contact us at support@tinywaffles.com and give us 30 days to try to resolve the matter informally. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent permitted by law. To the extent permitted by law, you and Tiny Waffles each waive any right to a jury trial and to participate in a class action.
Nothing in this section limits any non-waivable consumer-protection rights you have under the law of your place of residence.
15. Changes to these Terms
We may update these Terms from time to time. We will post the new version here and update the "Last updated" date; for material changes we will give additional notice inside affected apps or by email where we have your address. Changes take effect on the stated effective date, and continued use after that date means you accept them.
16. General
These Terms, the Privacy Policy, and any App Terms are the entire agreement between you and Tiny Waffles about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. Notices to you may be given by email or within the Services.
